Customer Privacy Notice

Thai Yamaha Motor Co., Ltd. (hereinafter called "we,""us," or "our") values your personal data and respects your privacy. This Customer Privacy Notice (hereinafter called "Privacy Notice") explains how we collect, use, disclose, and/or transfer your personal data as a customer or a person who interested in our product or service (hereinafter called “you” or “your”) at the present and in the future. This Privacy Notice applies to personal data that we collect, use, disclose, and/or transfer via communication platform both offline by face-to-face in the showroom, workplace, event, telephone, call center, or online communication by e-mail, social media, (such as webpage, Facebook or Line) platform or any other communication platform to provide you the products and services including the usage of Smart Reward Application and/or any other applications, our website or any intercommunication between you and us.

Personal Data Processing by Our Dealers: Please be notified that our all-authorized dealers are the business owners and are independent Data Controller that are not under our direct control. So, each dealer shall be liable for the protection of personal data that are collected, used, disclosed, or transferred by themselves. If you would like to know the practices of personal data privacy policies of the dealers, please contact relevant dealers directly.

 

1. Personal Data we Collect from You

“Personal Data” means any personal information that can be either directly or indirectly identified a person. As such, if we can gather any information and be able to identify a person, or if we can use any information to create your own information, we can imply that such information or gathered information is your personal data. We may collect or obtain from other sources as follows: including the personal information obtained from you directly or indirectly or from other sources via our dealers, affiliated companies, business partners, government agencies or other sources which are publicly disclosed, the services you need from us or the interrelation between you and us which will specify the way we collect the personal data.

  • (a) Personal details, such as title, first name, last name, gender, age, date of birth, marital status, nationality, work-related information education level, details and/or the copies of identification card, the copies of passport, the copies of census registration, the copies of driving licenses and the copies of card issued by government agencies, photograph, CCTV footage, signatures and other information you agree to disclose to us which may be considered as personal data.
  • (b) Contact details, such as telephone number, mobile phone number, fax number, mailing address, billing address, location information for delivering goods/services, email address, workplace, website account, social media account (such as Facebook account, Twitter account, Line account and Google account etc.)
  • (c) Financial details, such as salary, wage, special income, average income per month, details of bank accounts and finance information
  • (d) Vehicle details, such as vehicle serial number, vehicle brand, vehicle model, and information relating to purchasing of vehicles
  • (e) Technical Information, such as gadget information, time zone set up, browser data, versions of plug-in browser, versions of application, operation system, duration of website access, password or PIN Cookies, online cookies, record of access, record of connecting information for email services including cookies of IP address, IP numbers or the Internet Protocol (IP), record of respondence, clicking and moving mouses, address of Media Access Control, download defect, observing or searching products, status update, searching history, disclosing information connecting to social media, friend lists, check-in location, profile pictures, interests, proxy, user’s profile data, records of calls
  • (f) Other information, such as information relating to your purchase behaviors, history of use of our services and products, your comments, queries, feedbacks, complaints, and answers in the satisfaction questionnaire, preferences, interests or hobbies
  • (g) Sensitive information, such as religion in the ID card, face recognition and health information, we collect use or disclose your sensitive personal data only when receiving consent from you, or as required by laws.

If you provide personal data of any third party such as first name, last name, or you may request us to disclose personal information of a third party to the other parties, you will be liable to inform the details of this Privacy Notice to such third party, including request the consent of such party, (In case it is required to obtain consent). Moreover, you also have the obligations to proceed for us to be able to lawfully collect, use, or disclose their personal information as described in this Privacy Notice.

Generally, our activities (including sales of product and providing service) are not focus on minor, a quasi-incompetent person or incompetent person. So, if your age less than twenty (20) years or are not on completion of twenty (20) years of age following concerned Thai laws or you are a quasi-incompetent person or incompetent person or any other similar case, you must obtain the consent of your legal representative or guardian or curator before contact us or before provide personal data to us. We shall not collect, use, disclose, and/or transfer personal data of the minor aged less than twenty (20) years without the consent of his/her legal representative required by laws. Also, we shall not collect, use, disclose, and/or transfer personal data of a quasi-incompetent person or incompetent person without consent of his/her guardian or curator as required by laws.

 

2. Why Do We Collect, Use, Disclose and/or Transfer Your Personal Data
We collect, use, disclose and/or transfer to other countries of your personal data in accordance with the objectives as mentioned below upon the legal basis such as: (1) your consent; (2) the legal basis of entering into or performance of contract; (3) legal compliance; (4) legitimate interests of us or of any third party which balances between the interest and freedom of rights for protection of your personal data; (5) to prevent or suppress danger to one's life, body or health; and (6) public interest for the reason of proceeding along with public interest or government authorities.
  1. For Providing Products and Services to You: To enter into the agreement and perform our duties under it or any obligations with you or for providing services including selling vehicle, booking vehicles according to the specified campaign, using our application and website for you, as a customers, to be able to register and use mobile application, for complying with our product purchase agreement, including finance company or other financial institutes that cooperate with us upon the specified campaigns, for providing vehicles warranty, for communication and other services related to the insurance, for parking services, for registering and joining in training programs and test-drive.
  2. For Managing Relationships with You: To communicate with you about the products and services you receive from us and/or our authorized dealers for providing you the convenience on using products or services, to proceed according to the request of our service and appointment confirmation, to remind you to obtain maintenance services in order to maintain the warranty rights and/or to contact you to repair when having problems, to recall parts / spare parts, to inform any updates for handling with the questions and requirement relevant to the customer services, complaints, claims, insurance claims, disputes or compensation, to handle with technical problems, technical assistance, repairing, fixing, roadside assistance and emergency case, including with providing maintenance services and booking for repairing services and for providing the services relating to change of spare parts.
  3. For Operating Business: To analyze and manage our business, to do market research, to audit an account, to check the efficiency of our promotion campaigns and advertisement, to evaluate customer satisfactions and trend of customer behaviors, to deal and manage our business operation and our affiliate companies’ business operation to be efficient and accomplish, to evaluate and manage risks, to perform an internal audit and to manage internal business in order to be comply with the regulations, policies and any procedures
  4. For Improvement of Products and Services: To develop and improve the quality of products, services and our marketing activities, and to develop our new products and improving sale and our marketing plans
  5. For Marketing Communication: To market, to communicate, to sell, to offer special deals, to offer promotions, special privilege, reward, to organize the activities, to announce the winner of activities / rewards via platforms, to warn, to inform news and information relating to our products and services from the authorized dealers and/or business partners
  6. For Communicating with you: To understand your demand and interest, to survey customer satisfaction about our products, services and activities
  7. For IT Systems and Support: To manage our business including managing IT system, communication system and IT security system
  8. For Following up the Security Monitoring System: such as, personal confirmation, access control and record, monitoring system gadget and internet, IT security monitoring, crime prevention and solving including risk management and fraud prevention.
  9. For Dispute Handling: such as, solving disputes, enforcing our contracts; establishing, exercising, applying or defensing of legal claims
  10. For Compliance: such as, to comply with internal policies and applicable laws, regulations, directives, and regulatory guidelines of government authorities or competent authorities
  11. For Fraud Detection: To prove your identity and to check compliance with laws and other regulations and fraud prevention including doing the internal audits and records, property management, database on corruption, systems and other business controls.
  12. For Corporate restructuring purposes: in case of sale, transfer, merger, rehabilitation or other similar cases, we may transfer your personal data to any third party or more as a part of such operations.
  13. For Protection of Life: To prevent or suppress danger to one's life, body, or health.
  14. Where we need to collect your personal data as required by law, or for entering into or performing the contract we have with you and you fail to provide that data when requested, we may not be able to fulfill the relevant purposes as listed above or provide you the proper products or services.

    Where consent is required for certain activities of collection, use, or disclosure of your personal data, we will request and obtain your consent for such activities separately.
3. Methods of Collecting and Receiving Personal Data
We may collect and receive your personal data via the following methods.
  • (a) Personal data you provide to us: You may provide your personal information directly to us. It usually occurs when you contact us for information, fill out online forms or fill out documents, subscribe membership or register to receive or request for information about our products, services, or campaign/benefits, or when you post feedback to us.
  • (b) Personal data we collect from you automatically: We may collect certain technical data about your device and your search behavior which are collected through cookies and other similar technologies, for which we will notify you before use.
  • (c) Personal data obtained from the third parties: We will sometimes receive your personal data from others, such as our dealers, affiliate companies, our service providers or our business partner companies if those companies are authorized to disclose your personal data to us in accordance with their privacy policies and/or which you have given consent to disclose the data to those persons as the case may be.
4. To whom we may disclose or transfer your personal data
We may disclose or share your personal data with other parties whether or not living in Thailand or abroad, to the extent necessary to achieve the purposes set out above, such as our affiliates (e.g., Yamaha Corporation), our business partners (e.g., authorized dealers, hotels, finance companies or our cooperative financial institutes), third party service providers (e.g., (1) call center; (2) valet services; (3) tow services; (4) transportation and logistics services; (5) printing services; (6) internet, software, website developer, service providers of IT and companies which provide IT maintenance and support; (7) researching companies; (8) professional consultants (e.g., lawyers, technicians and account audits); (9) companies which provides marketing services, advertising media, design, create and communication); and (10) companies which provide services of campaigns, activities and marketing and customer relations)

In some cases, we may need to share your personal data in order to comply with laws and regulations, including law enforcement agency, such as Department of Land Transport, Revenue Department, court, regulator, government agencies or other third party where we believe this is necessary to comply with a legal or regulatory obligation, or otherwise to protect our rights, the rights of any third party or individual’s personal safety, or to detect, prevent, or otherwise address fraud, security or safety issues.

In some cases, we may have to disclose or share your personal data to our business alliances, investors, shareholders, assignees or persons who will be assignees, transferees or persons who will be transferees in case of corporate reorganization or corporate reconstruction, merger, acquisition, sale, buy, joint venture, transfer of right, dissolution, or any event similar to transfer or distribute of business, asset or shares partially or wholly.
5. International transfers of your personal data
We may disclose or transfer your personal data which we get from you to the third parties located abroad, such as Yamaha Motor Co., Ltd. located in Japan, including our affiliates and group companies in other countries for achieving business purposes, or for your benefits, or to proceed warranty issues, or disclose or transfer to the servers located outside Thailand for supporting IT system that is necessary for our IT operation which the Personal Data Protection Committee under the Thai Personal Data Protection Act B.E. 2562 has not ruled that this country has adequate data protection standard.

When it is necessary for us to transfer your personal data to a country with a level of data protection standards not equivalent to Thailand, we will follow the steps and procedures which are deemed appropriate for the safety when transferring your personal data, and to ensure that an adequate degree of protection is afforded to the transferred personal data, or the transfer is otherwise permitted in accordance with the applicable data protection law. We may, for example, obtain contractual assurances from any third party given access to the transferred personal data that such data will be protected by data protection standards which are equivalent to those required in Thailand.
6. How long do we keep your personal data
We retain your personal data for as long as it is reasonably necessary to fulfil the purposes for which we obtained it for and to comply with our legal and regulatory obligations. However, we may need to retain your personal data for a longer duration, as required and/or permitted by applicable law, including our internal policies or working procedures.
7. Your rights as a data subject
Upon the applicable laws and relevant exemptions, you are entitled to proceed in accordance with your personal data as follows:
  • Accession: you may request us to obtain the information relating to the collection, use, disclose and/or transfer of your personal data including with a copy of your personal data, or for the disclosure of the acquisition of your personal data that is obtained without your consent;
  • Data correction: you may request us to correct your personal data which is incomplete, inaccurate, which could cause any misunderstanding or not up-to-date to have your personal data rectified or corrected;
  • Erasure or destroy: you may request us to delete, destroy or to have your personal data anonymized as required by laws;
  • Data transfer: you may request us to provide your personal data in a structured, commonly used and machine-readable format, and transmit or transfer it to another data controller;
  • Objection: you may object when we collect, use or disclose your personal data in certain activities specified in this Privacy Notice, and for achieving direct marketing purposes, which includes profiling related to such direct marketing;
  • Restriction: you may request us to be restricted from using your personal data if such data is in the process of checking in order to proceed such data to be up-to-date, complete and not causing any misunderstanding, or whether such data is necessary to be deleted due to the unlawful collection etc.;
  • Consent withdrawal: you may request us to withdraw your consent for collection, use or disclosure of your personal data, unless there is any restriction regarding the withdrawal by laws or for your contractual benefits;
  • Complaints: you may request to lodge a complaint to the competent authorities that have collected, used or disclosed your personal data, whether in case we are processors or a third-party processes on behalf of us, nevertheless; we would, appreciate the chance to deal with your concerns before you approach the authority.

Your request for exercising any of the above rights may be limited by the applicable laws and relevant exceptions. There may be certain cases where we can reasonably and lawfully decline your request; for example, due to our legal obligation or a court order. If we decline your request, we will notify you of our reason.
8. Changes to this Privacy Notice
We may amend or update this Privacy Notice from time to time. Please consider the Privacy Notice periodically for checking the latest amendment. The amendments to this Privacy Notice will be effective upon being published by us on www.yamaha-motor.co.th/en_customer_privacy_notice. We will notify you or request your consent if necessary due to the material changes in this Privacy Notice as required by laws.
9. Links to connect to Others’ Website
For website user, our services may contain links to another social networks and websites having third parties as data controllers and/or data processors. Generally, we will link to high standard websites that respect your privacy at the same level as us. However, we are not responsible to the content or other privacy practices of other websites. Your personal data provided to others’ websites is the personal data which such third parties are collectors, not us, and such personal data will be subject to third parties’ privacy notices (if any), and not subject to this Privacy Notice. In such case, we do not have an obligation to control and be liable to the personal data you submitted to a third party that is used by such third party.
